A client requested a retaining wall to be designed to protect  the client's  dwelling following an earthquake and  rain event. Another severe rain event occurred some months later, before the retaining wall was designed, exacerbating the damage caused by the original events. A consulting company arranged for a Geotechnical report and designed the retaining wall to protect the dwelling on the property from future earthquake or rain events. This was duly constructed as designed.  Upon completion, the coverage of the wall was questioned by the Client and an an impasse was created.
 
The Client's  appeal of an investigation committee's decision to dismiss the complaint against the two CPEng's was dismissed by the CPEC Appeal Panel.
