Appeal Ruling #88: 01 November 2025

The appeal is of a decision by the Investigating Committee acting as the Adjudicator for the Registration Authority to dismiss a complaint on the basis of r57(a) by a chartered professional engineer, about another CPEng, rather than to refer it to an Investigating Committee. The Appeal Panel has determined that, in all of the circumstances, the complaint should be dismissed on the basis of rule 57(ba) of the Rules. That is, the alleged misconduct is insufficiently grave to warrant further investigation. Therefore, the Appeal Panel reverses the decision of the CIC to dismiss the complaint on the basis of rule 57(a) and instead dismisses it on the basis of rule 57(ba).
